Brennan Professor Emeritus of Law and adjunct professor of political science, noted a legal gray area in an instance of three judicial candidates who endorsed bans on abortion. He said the candidates have the First Amendment on their side, although they need to be cautious of a provision that warns against saying anything that could be seen as biased in questionnaires.
