Associated PressAndrew Pollis, professor of law and director of the Appellate Litigation Clinic at the Milton and Charlotte Kramer Law Clinic, discussed the death of a Massachusetts teenager after his family said he ate an extremely spicy tortilla chip following a social media challenge. The event has led to an outpouring of concern and to retailers pulling the product from their shelves at the manufacturer’s request. Pollis said that a lawsuit brought by a family would hinge in part on whether the chip's warning label was adequate—essentially whether it was foreseeable that a child would consume the product despite the warning.
